The following Terms and Conditions apply to your use of the ITF Player Support Programme website available at playersupport.itftennis.com.
These Terms & Conditions form a legally binding agreement between you and the International Tennis Federation in relation to your use of the Website. It is important that you take time to read them carefully.
In case of any discrepancy between the English and Spanish versions of these Terms & Conditions, or any other content within the Website, the English version shall prevail.
1. Introduction
The ITF Player Support Programme Website is owned and operated by ITF Licensing (UK) Limited ("the ITF") of Bank Lane, Roehampton, London, SW15 5XZ, United Kingdom. We are incorporated in England & Wales with the company registration number 2584446, and VAT number GB726079327.
These Terms & Conditions were last updated on 23 January 2014 and replace all previous terms & conditions for playersupport.itftennis.com. If we need to update these terms & conditions for any legal or regulatory reasons, or if we change the nature of the services offered, we will post the most recent version here and inform any registered users of the changes by email.
2. Privacy
Acceptance of these Terms & Conditions amounts to full acceptance of the use and the processing by us and our nominated third parties of your personal data in accordance with the Privacy Policy. Please see our Privacy Policy, which is part of these Terms & Conditions, for further details.
3. Registration
You are required to provide the ITF with your Personal Data via this website as a condition of registration with the ITF Player Support Programme.
Your ITF Player Support Programme registration is not transferable and you may not allow your ITF ID be used by another person.
The ITF reserves the right, at its absolute discretion to refuse any registration application or renewal. The ITF also reserves the right to suspend or cancel at any time and without notice the registration of any person who is found to have been in breach of these Terms & Conditions or any ITF Circuit Regulations.
4. Your Account
You are responsible for maintaining the confidentiality of your ITF ID account and password details and for restricting access to your computer to prevent unauthorised access to your account.
You may not transfer your account to anyone else.
You should take all necessary steps to ensure that your password is kept confidential and secure at all times and should inform the ITF immediately if you have any reason to believe that your password has become known to anyone else, or if your ITF ID is being, or is likely to be, used in an unauthorised manner to access your account.
5. Your Conduct
You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged, or impaired in any way.
You understand that you are solely responsible for all electronic communications and content sent from you to us and you must use the Website for lawful purposes only.
You must not use the Website for any of the following:
- For fraudulent purposes, or in connection with a criminal offence or other harmful or unlawful activity.
- To distribute, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing or in breach of copyright, trademark, confidence, privacy or any other right or is otherwise injurious to third parties or objectionable or which consists of or contains software viruses, Trojan horses, data scraping, keystroke logger, spyware, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam".
- To cause annoyance, inconvenience or needless anxiety.
- To obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website.
6. Access to this website
Children Under 16: if you are under 16, you are not eligible to register for the ITF Player Support Programme.
7. Choice of Law and Jurisdiction
These Terms shall be governed by, and construed in accordance with, English law. You warrant that your use of the Website complies with any applicable law in your jurisdiction.
The parties irrevocably agree that the courts of England shall (subject to the clause below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
The ITF shall retain the sole right to bring enforcement proceedings in your country of residence.
8. Copyright and Database Rights
All copyright, trade marks, rights in databases and any other intellectual property rights which subsist from time to time in all text, copy, source code, images, sound, software, data compilations, service marks, logos, the ITF name and the domain itftennis.com and any other material featured on the Website ("the Content") are, as between you and the ITF, owned by the ITF, its affiliated companies or reproduced on the Site with permission of the relevant rights owner.
The contents of the Website may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without the ITF’s prior written consent, except as stated below.
You may read, view, print and download the Content for private and personal non-commercial use only provided that all copyright, trademark and other proprietary notices contained in or around the Content is retained, but you may not make more than one copy electronically or otherwise of any of the contents and you may not recopy or further distribute, sell, publish or transmit any part of the Content by electronic or any other means.
You may not systematically extract and/or re-utilise parts of the Content of the Website without the ITF’s express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Website, without the ITF’s express written consent. You also may not create and/or publish your own database that features substantial parts of this Website without the ITF’s express written consent.
You agree not to sell, resell, supply or otherwise make the Content or extracts or other information derived therefrom available in any manner or on any media to any third party without the prior written consent of the ITF.
9. Warranties & Liabilities
The ITF will not be liable to you through your use of the Website in respect of the following:
- direct or indirect business losses (including without limitation economic loss, loss of profit, loss of business, loss of anticipated savings, loss of goodwill, loss of reputation);
- indirect, special or inconsequential loss;
- any loss (whether direct or indirect) arising from events outside of our control;
- any loss (whether direct or indirect) in respect of loss of or corruption of data, database or software.
The ITF gives no warranty, expressed or implied, that the Website will function and be accessible at all times correctly as intended.
The Content may contain inaccuracies or typographical errors. The ITF makes no warranty that any statements or text within this Website is accurate and accepts no liability for any lack of accuracy therein.
You accept that the ITF gives no warranty whatsoever that use of this Website, including engaging in email correspondence with the ITF and others and the downloading of files, will not expose your hardware and/or software to computer viruses, or worms, Trojan horses or other code of a damaging nature. It is your responsibility to put in place appropriate protections.
The ITF accepts no responsibility for the content and functioning of other websites that you may access through this Website or which are linked to this Website, nor does the ITF endorse the content of such other sites.
10. General
Any failure by the ITF to enforce any of its rights under these Terms & Conditions shall not be construed as a waiver of any of its rights herein.
The waiver by the ITF of a breach or default of any of the obligations hereunder by you shall not be construed as a waiver of any succeeding breach of the same or other obligations nor shall any delay or omission on the part of the ITF to exercise or avail itself of any right power or privilege that it has or may have hereunder operate as a waiver of any breach or default by you.
